Reflections on the Fujian High Court on the case of Hong Kong companies transferring equity of mainland companies to enjoy agreed treatment
This case is currently one of the few public judicial judgments in China on the enjoyment of agreed treatment for the transfer of equity of non-resident enterprises (Fujian Higher People’s Court (2022) Fujian Provincial Administrative Judgement No.360). The focus of the dispute is challenging and of guiding significance to practice.
